Oregon Smokefree Workplace law
On January 1, 2009, the Oregon Smokefree Workplace Law expanded to require additional workplaces to be smoke free, including bars and bar areas of restaurants, bingo halls, bowling centers, employee break rooms, and at least 75% of hotel sleeping rooms. The new law also prohibits smoking within 10 feet of entrances, exits, windows, and ventilation intakes of workplaces or public places.
As of January 1, 2016, people may not use e-cigarettes and other inhalant delivery systems in any indoor public spaces in Oregon, or within ten feet of doors, windows that open, air intake vents or accessibility ramps.
I Own a Business. How Can I Comply with the Smokefree Workplace Law?
- Prohibit smoking and vaping in the workplace and within 10 feet of all entrances, exits, windows and air intake vents.
- Post signs at each entrance and exit providing notice that smoking and vaping is prohibited within 10 feet.
- Provide training to employees on how to ask visitors and patrons not to smoke or vape.
- Encourage and support employees and customers who want to quit smoking. Anyone can call the Oregon Tobacco Quit Line (1-800-QUIT.NOW or 1-877-2NO-FUME) for free confidential help with quitting.
How is the Law Enforced?
The new law places the responsibility on business owners to maintain a smoke and vape free environment. Individuals who smoke or vape will not be cited for smoking inside or outside a business. Oregon business owners or employers found in violation of the law are subject to a fine of not more than $500 per day with a maximum of $2,000 in any 30-day period.
How Do I Report a Violation of the Smokefree Workplace Law?
Employees and the public may report violations of the law by completing an online complaint form, or, if unable to access the online form, by calling 1-866-621-6107. Complaints will be investigated and violations pursued.
